1. Key Principles & Statements

Sitthinan Company Limited has full awareness of the vital importance of the protection of personal data which is the basic rights for human beings. This privacy statement is prepared primarily in line with the Personal Data Protection Act 2019 (PDPA) under The Constitution of the Kingdom Of Thailand. A person cannot be subjected to harassment of his or her right to personal information which causes the data subject to be defamed, insulted, hated or be socially devalued. Everyone has the legal right to the protection of personal data concerning him or her. In order to respect the rights of individuals, the company announces the clear principles and guidelines of how personal Data Protection of our clients and relevant parties are obtained and used as following;

“Personal Data” means any information relating to a Person, which enables the identification of such Person, whether directly or indirectly. This includes company employee data, buyer data, seller data, service provider data, contact person data, and job application data.

The processing of personal data is conducted lawfully, fairly and in a transparent manner. The company will collect personal data only as necessary under lawful purposes, and only for the purposes that have been notified to you before or at the time of the collection of personal data. The personal data pertaining to racial, ethnic origin, religious or philosophical beliefs, health data, disability, genetic data, biometric data, will be collected only when the data subject has given consent prior to or at the time of such collection, use, or disclosure unless:
(1) it is necessary for compliance with a law e.g. Personal Data Protection law, Electronic Transaction law, Anti-money Laundering law, Thailand Civil and Commercial Code, and The civil procedure code
(2) it is necessary for the police officer’s investigation or the court proceedings.
(3) it is for the benefits of the data subject and the consent is not able to be obtained at the time of the collection of personal data
(4) it is for the legitimate interest of the company or any other legal entity
(5) it is to prevent or suppress a danger to life, body or health of the Person
(6) it is necessary for the performance of a contract to which the data subject is a party, or in order to take steps at the request of the data subject prior to entering into a contract
(7) it is for the scientific, historical, or statistic research purposes, or other public interests which is carried out only to the extent necessary to achieve such purposes, and the suitable measures have been provided to protect the fundamental rights and interest of the data subject

4. Personal Data security and protection

The company recognizes the importance of personal data security. We implement appropriate measures to keep your personal data safe from accidental or unlawful destruction, loss, alteration, unauthorized disclosure Personal data such as name, age, address, phone number, ID card number, and other identifiable data of an individual data subject will only be utilized for company legitimate purposes and are secured with appropriate measures to protect the rights of the data subject.

5. The purposes of collection, storage, and use of personal data

The company will collect, store, and use personal data to maximize your benefit and provide services to fulfill your interests such as newsletter service, electronic communication, market research, company marketing, marketing analysis, product offerings, and for any other purpose that is not prohibited by law, permitted by law, and/or for compliance with current and future laws or regulations. The company may send, transfer, and/or disclose your personal data to the business partners, affiliated companies, external service providers, data analytics companies, any public and legal entities located in Thailand or a foreign country for the benefit of the company’s operations. We will only keep your personal data for a period of time that is appropriate and necessary for each type of personal data and for the purposes as specified by the PDPA.

Anyhow, the company may use a third-party company for personal data processing and personal data storage. The data processor must have appropriate data security measures. Data collection, usage and disclosure of personal data is prohibited if not agreed and permitted from the company.

7. Rights of the data subject

As a data subject, you are entitled to the protections under the Personal Data Protection Act B.E. 2562 as follows:
(1) Right to request access and right to obtain a copy of the personal data such as a copy of personal data according to company rules and regulations, or request for disclosure of the acquisition of personal data that the Company has obtained. However, the Company reserves the right to reject such request if such refusal is in accordance with the law or court order.
(2) Right to access, amend and change personal data that is incomplete, incorrect or not up-to-date.
(3) Right to request the company to erase, destroy or make personal data unidentifiable unless it is the case where company must comply with the law in retaining such personal data
(4) Right to withdraw the consent unless there are lawful restrictions
(5) Right to file a complaint in the event that the data controller or the data processor, including the employees of both parties, violates or does not comply with the personal data protection law To exercise the rights indicated above, you can contact our agencies or submit a written form as prescribed by the personal data protection law. 8. Announce and changes in Policies

The company is committed to comply with all the relevant laws by announcing the guidelines of personal data protection. The company may update, amend this policy to ensure conformity with legal provisions. The changes will be made available on the company’s official website at https://www.sittinan.co.th

9. Data Protection Officer

The company will comply with the Personal Data Protection Act 2019 (PDPA) by appointing a Data Protection Officer (DPO) to ensure that the company’s collection, use, and disclosure of personal data is compliant with the Personal Data Protection law and any relevant law.

10. Policy review

The company shall review its Personal Data Privacy Policy every year or whenever there arises any significant change to ensure its consistency with the laws, regulations and practices concerned.
